In Canada, there are three bases for entitlement to spousal support: compensatory, contractual, and non-compensatory.

The compensatory ground for spousal support recognizes that when a relationship ends, spouses are entitled to be compensated for contributions to the relationship/marriage and for economic losses sustained as a consequence of the relationship.

The non-compensatory support recognizes that the relationship/marriage is a joint endeavour premised on mutual support, and partners may have an obligation to meet or contribute to the needs of their former partners where they have the capacity to pay.

The contractual basis is usually based on the agreement that the parties had before or during the relationship, such as prenuptial or postnuptial agreements, which are generally referred to as cohabitation agreements.
